Final ICTS rule offers some clarity, still gives Commerce broad authority

The final interim rule the Commerce Department issued on Thursday offers industry some clarity on the scope of technology products it will cover but still gives the Commerce secretary broad discretion to block imports of information and communications technology and services from “foreign adversaries.” In comments on a November 2019 advance notice of proposed rulemaking, industry groups complained about what they feared would be nearly unbridled authority for Commerce to block ICTS transactions.
